Notice of Decision to Extend Interim Control Bylaw 021-2019

 

TAKE NOTICE that the Council for the Corporation of the Township of Wainfleet passed an amendment to Interim Control By-law 021-2019 on the 10th day of March, 2020 under Section 38 of the Planning Act, R.S.O. 1990, c.P.13, as amended, through By-law 009-2020.

 

Interim Control By-law 021-2019 has been extended for a period of eight months and will be in effect until 11:59 p.m. November 26, 2020, unless extended by Council in accordance with Section 38 of the Planning Act, R.S.O. 1990, c.P.13, as amended, or repealed by Council at an earlier date. Council has the authority to extend the bylaw until March 26, 2021 and no later, being two years from the passage of the original bylaw.

 

PURPOSE AND EFFECT OF BYLAW 009-2020

The purpose of Interim Control By-law 009-2020 is to extend the period of time during which Interim Control Bylaw 021-2019 will be in effect to 11:59 p.m. on November 26, 2020. Interim Control Bylaw 021-2019 prohibits the use of any land, building or structure for any cannabis production whatsoever, except for a cannabis production facility that lawfully existed on the date of passage of the bylaw (March 26, 2019) as long as it continues to be used for such purpose.

 

The Interim Control Bylaw provides the Township with the opportunity to undertake a review of the Township’s land use planning policies and regulations pertaining to cannabis production facilities and cannabis related uses. The review will identify and assess options to regulate the placement of cannabis production facilities and cannabis related uses through zoning considerations as well as to identify and assess site plan control guidelines for such uses.

 

This bylaw applies to all properties within the municipal boundary of the Township of Wainfleet. A complete copy of the bylaw can be found here.

 

APPEAL INFORMATION

The last day for filing a notice of appeal to the Local Planning Appeal Tribunal is no later than 4:30 p.m. on May 11, 2020. A notice of appeal of appeal setting out the objection to the bylaw, the reasons in support of the objection and the fee required by the Local Planning Appeal Tribunal must be filed with the Clerk of the Corporation of the Township of Wainfleet.

 

Only individuals, corporations and public bodies may appeal an interim control bylaw to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
